Members of the PA and EB bargaining units: grieve if you failed to receive June 1 notice of your severance information!

June 1 was an important date for NHU members belonging to either the Program and Administrative Services (PA) or the Education and Library Science (EB) bargaining units.
That was the deadline for the employer to have notified PA and ED members of their projected years of continuous employment to be applied to the severance provisions negotiated in the current collective agreement. Note that July 6 is the deadline for NHU members belonging to the Operational Services (SV) bargaining unit.
Why is this important? Because timely notification will allow you the time to make a careful decision on how you wish to have your severance paid out.
The contract language involved is the following:
Article 63.06 - Selection of Option
(a) The Employer will advise the employee of his or her years of continuous employment no later than three (3) months following the official date of signing of the collective agreement.
(b) The employee shall advise the Employer of the term of payment option selected within six (6) months from the official date of signing of the collective agreement.
(c) The employee who opts for the option described in 63.05(c) must specify the number of complete weeks to be paid out pursuant to 63.05(a) and the remainder to be paid out pursuant to 63.05(b).
(d) An employee who does not make a selection under 63.06(b) will be deemed to have chosen option 63.05(b).
Here is suggested wording for your grievance:
Grievance:
I grieve Article 63, and more specifically Article 63.06 (a) of the Collective Agreement
as the Employer has failed to provide me my years of continuous employment.
I grieve all other related Collective Agreement Articles.
Corrective Action:
• that I be properly informed of my years of continuous employment
immediately;
• that for each day of delay in being informed of my years of continuous
employment that an extension to the six (6) months as stated in Article
63.06 (b) be granted accordingly;
• that I receive make-whole compensation for all losses in wages, benefits, costs and expenses
incurred by me as a result of the Employer's violation;
• any further compensation and corrective measures that a Board or Tribunal
may deem appropriate; and
• that I be made whole.
Treasury Board has indicated that any delays in the proper notification of severance information will see the deadline for an employee decision extended.
The NHU urges you to protect your rights by filing this grievance in a situation where you have not been made aware of your years of continuous employment for severance purposes.

New NHU Guide a useful Convention primer

Local delegates from across Canada will come together in Ottawa next August at the NHU's 2011 Triennial National Convention. For many of them, it will be their first such meeting.
